  • Chapter 7

    A Chapter 7 bankruptcy wipes out unsecured debts such as credit cards, medical bills, private loans, and in some cases older back taxes.  A Chapter 7 provides a "fresh start" for debtors.  Debtors are allowed to keep their assets up to certain dollar limits.  In the vast majority of cases the debtor has no assets that he or she would lose.
  • Chapter 13

    A Chapter 13 Bankruptcy provides for repayment of debts under a payment plan lasting between 3 to 5 years generally.  Chapter 13 is often used by debtors because they do not qualify for Chapter 7 or  to catch up on a mortgage or car loan.  Chapter 13's allow the debtor to complete their payments on secured debts such as their mortgage or car loan, and pay unsecured creditors a small percentage within 3 to 5 years under bankruptcy court supervision/protection.

FAQ

1) WILL CREDITORS STOP HARASSING ME AFTER FILING BANKRUPTCY?

Yes, once creditors get notice of the bankruptcy they cannot contact you, nor start/continue lawsuits or garnishments.  If a debtor wants to retain property with secured creditors (such as a mortgage or a car loan) payments must be kept up.

2) WHO WILL KNOW ABOUT THE BANKRUPTCY?

Although a bankruptcy becomes public record, an entity or individual must have access to bankruptcy records or credit reports.

3) CAN I EVER OBTAIN NEW CREDIT?

Yes, many banks offer secured credit cards to start out with, and other types of credit is attainable after bankruptcy.  We can offer advice on rebuilding your credit after bankruptcy.

4) WHAT DOES IT COST?

We charge a flat fee that is very competitive.  The bankruptcy court charges a  filing fee ($299 for Chapter 7, and $274 for Chapter 13).  Also, one class must be completed before filing for as low as $30 and a second class after filing for as little as approximately $14.  Both classes are available online or by phone.
